1. DEFINITIONS

"Customer" means any person or entity purchasing products or services through the Website.

"Customized Product" means any product that has been modified, printed, engraved, embroidered, branded, packaged, or otherwise customized according to customer specifications.

"Order" means any purchase request submitted through the Website.

"Website" means www.mishkatkw.com and all related pages, content, and services.

1. ELIGIBILITY

4.1 You must be at least eighteen (18) years old and legally capable of entering into binding agreements.

4.2 If placing an order on behalf of a company or organization, you represent that you are authorized to act on its behalf.

5.2 Customers are responsible for maintaining the confidentiality of their account credentials.

1. PRODUCTS AND SERVICES

6.1 The Website offers corporate gifts, promotional products, customized merchandise, electronics, drinkware, stationery products, gift sets, apparel, and related products.

6.2 Product images are provided for illustrative purposes and may differ slightly from actual products.

6.3 Product specifications, availability, colors, dimensions, and packaging may vary.

6.4 We reserve the right to discontinue or modify products without prior notice.

1. CUSTOMIZED PRODUCTS

7.1 Customized Products are manufactured or prepared according to customer instructions and approved artwork.

7.2 Customers are solely responsible for reviewing and approving artwork, logos, spelling, colors, layouts, and design specifications.

7.3 Production will commence only after:

a. Artwork approval; and

b. Receipt of required payment.

7.4 Once production has commenced, orders for Customized Products cannot be cancelled.

7.5 Customized Products are non-returnable and non-refundable except in cases of manufacturing defects, incorrect customization caused by the Company, or damaged products delivered to the customer.

1. ARTWORK AND INTELLECTUAL PROPERTY SUBMISSIONS

8.1 Customers warrant that they own or have obtained all necessary rights, permissions, licenses, and approvals to use any logo, artwork, trademark, image, design, text, or other material submitted to the Company.

8.2 Customers indemnify and hold the Company harmless from any claims arising from submitted materials.

8.3 The Company reserves the right to reject content that may be unlawful, defamatory, offensive, misleading, or infringe third-party rights.

1. ORDERS

9.1 All orders are subject to acceptance by the Company.

9.2 An order confirmation does not constitute final acceptance until payment verification and product availability are confirmed.

9.3 We reserve the right to refuse, limit, cancel, or modify orders at our discretion.

1. PRICING

10.1 Prices displayed on the Website are in Kuwaiti Dinars (KWD).

10.2 Prices may be changed without notice.

10.3 Pricing errors may be corrected at any time before order fulfillment.

10.4 Delivery charges, if applicable, will be disclosed during checkout.

1. PAYMENT

11.1 Payment may be made through approved payment methods available on the Website.

11.2 Customized Product orders require payment before production begins unless otherwise agreed in writing.

11.3 Corporate customers may be granted credit terms subject to separate agreements.

1. DELIVERY

12.1 Delivery is available only within Kuwait.

12.2 Estimated delivery times are indicative only and do not constitute guaranteed delivery dates.

12.3 Mishkat International shall not be liable for delays caused by circumstances beyond its reasonable control.

1. RETURNS AND REFUNDS

13.1 Non-customized products may be returned within fourteen (14) days of delivery provided they remain unused, undamaged, and in their original condition.

13.2 Customized Products are not eligible for return or refund except as expressly provided in these Terms.

13.3 Refunds approved by the Company shall be processed within fourteen (14) days following approval.

1. PROHIBITED USE

Customers shall not:

a. Violate applicable laws;

b. Interfere with Website operation;

c. Upload malicious code;

d. Attempt unauthorized access;

e. Misrepresent identity or affiliation;

f. Use the Website for fraudulent activities.

1. INTELLECTUAL PROPERTY

15.1 All Website content, trademarks, graphics, text, logos, images, software, and materials are owned by or licensed to the Company.

15.2 No content may be copied, reproduced, distributed, modified, or commercially exploited without prior written consent.

The Company shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, governmental actions, utility failures, labor disputes, transportation interruptions, or other force majeure events.

1. TERMINATION

21.2 Termination shall not affect rights and obligations accrued prior to termination.

1. GOVERNING LAW AND JURISDICTION

22.1 These Terms shall be governed by the laws of the State of Kuwait.
